Written evidence from Miss Diana Rhodes (CIL1310)
To whom it may concern
I am a living breathing woman, a sovereign being of the United Kingdom, I write this as a concerned, law abiding woman with inalienable rights, who has been impacted in numerous ways and have observed the devastating effects within my community and have witnessed the unlawful actions of the government and police with regards to the measures that are in place.
Everyone has been impacted by the measures introduced, some groups have been more affected than others, but none the less every living man, woman and child has been affected. I wish to point out two vital things.
- The Civil Contingencies Act 2004 was overlooked as a mechanism by which the UK government could have used in order to appropriately and proportionally deal with the perceived threats of the Coronavirus/ covid 19. The time and effort put into setting up, debating and discussing the formation of the cornonavirus act 2020 was in my view a waste of valuable time and resources that would have best been served establishing a suitable response to the perceived threat and therefore timeously identifying the vulnerable groups and those most at risk as a first priority, acting to protect them and allowing those not vulnerable or at risk to continue going about their usual business and living their lives.
- covid -19 was first classified as a HCID in the UK on 16.1.2020 , it was down graded and no longer considered a HCID by public health England two days before the first lockdown in March 2020.
I therefore submit that the lockdown measures and subsequent introduction of fines, mask wearing, social distancing, restrictions on movement, closing of businesses, the right of assembly and association, access to elderly in care settings, denial of health treatment, denial of youth to education, denial of access to family together with threats of fines and many more draconian measures are and should be considered unlawful and disproportionate given that Coronavirus/ Covid 19 was no longer a HCID.
∙ The impact of lockdown on university students has been devastating, their learning has been irreversibly impacted as has their future, their right to liberty and right to private and family life has been disproportionately affected, the FPN issued to students has been disproportionate and unlawful, student suicides across the UK are said to be at an all time high.
∙ The impact of lockdown on the freedom of assembly, specifically that of religion, belief and collective worship has interfered with the fundamental right of association, gathering and support offered by religious bodies and has impacted everyone and is unlawful and disproportionate.
∙ I do not agree that the current Government guidance relating to Care homes and hospital visits has struck the correct balance between the right to private and family life and the right to life, the measures applied are not fair, they are disproportionate, unlawful and inhumane, the DNR is one example.
∙ Actus Regis Nemini Facit Injuriam. Each man, woman and child have Inalienable rights as well as human rights and the impact of extended lockdown restrictions and those areas subjected to the most stringent, lasting, lockdown conditions are unlawful. The impact on the inalienable and human rights on family life and mental health for all communities has
been and is devastating, leading to domestic violence, child abuse, deprivation, poverty, neglect, undiagnosed illness, lack of life saving treatment, increase in the consumption of alcohol and drugs and suicide of both adults and teenagers and the denial of large gatherings to attend funerals and the loss of earnings leading to poverty and crisis. The best way to address these disproportionate measures is to protect the elderly and vulnerable, end lockdown and allow everyone who is able bodied to go about their business and lives as are their fundamental rights.
∙ Policing of Lockdown. The use of Fixed Penalty Notices (FPNs) for lockdown offences is disproportionate, unfair and discriminatory for a few fundamental reasons. The issuing of FPNs is being used as a tool to control, deter and threaten those who wish to use their rights to visit family/friends, to travel or go about their business. The FPN is unlawful and there must be an adequate way to seek a review or appeal of an FPN. The FPN fines are inappropriate and disproportionate and considering that the majority of people in the UK have been financially impacted by the lockdowns not one particular group has been impacted, everyone has been affected. FPN however were not issued to those government officials who broke lockdown rules.
∙ The right to protest has been taken away by virtue of the lockdown restrictions including gatherings and freedom of association, for those who oppose the lockdown, yet the right to protest by antifa, blm and climate change activists were not policed, fined or coerced into leaving the protest, the FPN is a tool being used to remove fundamental rights, threaten, deter and otherwise put people into financial hardship, which is already apparent with the loss of earnings due to the lockdown and I therefore submit that no balance has been struck.
