Politician claims UK Supreme Court is a “monster of Tony Blair’s making”

The Supreme Court of the United Kingdom yesterday ruled that Boris Johnson’s prorogation of parliament was unlawful. Many are speculating as to the impact of yesterday’s ruling. Prime Minister Boris Johnson is still vowing that the UK will leave the EU on October the 31st, with or without a deal. Mr Johnson insists that he was simply following normal procedure to allow for a queen’s speech. Yesterday’s Supreme Court judgement undoubtedly will affect Britain’s unwritten constitution and the entire balance of power between Britain’s respective institutions. 

Attention over the last 24 hours has increasingly turned towards the positioning of the Supreme Court in British politics and many have made comments regarding this. One such person to comment was David Kurten the Brexit Alliance and London Assembly Member. Mr Kurten stated on twitter “The UK Supreme Court is a monster of Tony Blair’s making. This unelected, unaccountable cabal has effectively elevated itself to a position where it can overrule the Queen. This cannot be either the Crown in Parliament is sovereign, or the Supreme Court is sovereign, but not both”. 

These calls questioning the Supreme Court’s positioning is seen by many as a move towards an American style model of politics as well as a written constitution. The Brexit process has repeatedly tested Britain’s uncodified constitution and has potentially placed so much stress upon it that the effects are now irreversible. The possibility looms large that the precedent set yesterday could spell the gradual eradication of constitutional monarchy that has previously existed. The Supreme court will be 10 years old on 1 October and it has so far heard 835 appeals, none have previously been as high profile. 

The Supreme court was formed with very little tangible opposition. However, Lord Neuberger was highly critical as he feared that the new Supreme court would assert itself in opposition to the government, many will say that this was what happened yesterday. Mr Neuberger stated that he thought that “judges arrogating to themselves greater power than they have at the moment” would be probable.
