ANALYSIS-What is the future for the Tilbrook Case?

Hopefully you will have managed to watch my full interview last night with Graham Moore about the Article 50 case where I learned so much more about the case and the way in which the judiciary works. I would like to now summarise some of the key points and how things may move forward.

The key element from the Judges response is that he has stated that the case is ‘Totally without merit’. This is a term I was not familiar with previously but Graham explained that this was brought in under the Blair Government when dealing with Asylum claims in order to stop vexatious claims continually coming back to the court. It operates a three strikes and you are out system whereby you cannot keep bringing cases to court and will be barred from doing so if your cases have no merit. Mr Tilbrook therefore now has one strike in The English Democrats name.
