The Trial of Dennis Hutchings.
The trial of Dennis Hutchings for alleged crimes committed more than forty years ago is a miscarriage of justice and should not be taking place. Not because he was a soldier but because the incident was previously investigated four times by the legal authorities.
The decision not to give Dennis a trial by jury is a controversial one but it might be the best one for him under the circumstances.
The alleged crime took place in Northern Ireland so the trial will take place in Northern Ireland. We know that the province has a huge problem with organised crime. The criminals known under the generic term IRA will murder and kill if they think it advances their cause. As a result, it would be easy for these criminals to coerce a jury.
The case against Dennis is weak and has been pursued for political and financial reasons. If it is simply a matter of law then the case will fall apart very quickly when it comes to court. There is no new evidence – unless forty-year-old memories and wishful thinking count as evidence. The police investigation has been described by experts as incompetent and possibly illegal.
If the decision is made by a Judge who we must all hope to be courageous and honest then Dennis will be exonerated once and for all.
Many of us have lost faith in a system that allows such trials to take place and we clearly have no faith in our government but we must give the judiciary the chance to do their job and believe that right will prevail as it has previously. I whole-heartedly believe that he will win.
That does not mean that our fight is over nor that we should reduce our protests. Dennis is one of many and it is the many we are fighting for. We must continue to shout and – If they don’t listen we will shout louder!
