Simon Dolan’s Judicial Review has been dismissed by 3 different Courts with the Supreme Court refusing to hear the case.
The key challenge from Simon Dolan’s lawyers is that the original lockdown measures were ‘ultra vires’ – or outside the scope of the 1984 Public Health act which was used to implement them.
It would appear that the next step would be to take the case to the European Court of Human Rights, (ECHR) but would the case fare any better there?
I have in a previous article called into question the Impartiality of the ECHR written in relation to a report released by the European Centre for Law & Justice (ECLJ).
This report exposed the relationships existing between several judges of the European Court of Human Rights and NGOs that are active before the Court
UNITED NATIONS OBJECTIVES
The United Nations (UN) is currently made up of 193 member states. The UN Charter of 1945 is the Treaty of the UN acting as an intergovernmental organisation. As a Charter it is a Constituent Treaty, and all members are bound by its articles.
They state Governments and international bodies should promote and allow the participation of NGOs at all levels participating fully in the United Nations system from policy-making and decision-making to implementation.
Analysis
During the “covid” period we have witnessed almost identical policies being rolled out at speed globally. Could it be the decision-making process is largely carried out outside of the democratic process between civil servants, a global network of NGOs/Civil Society Organisations and public/private partnerships?
Where do “the people” go for redress when the separation of powers no longer exists?
A crucial question and one that I cannot answer.
We can only hope that the Dolan case is escalated to the ECHR because only when you shine a light on hidden agendas can they be exposed and dealt with.
