- This was the third and final day of the Supreme Court hearing into whether Boris Johnson and his Government acted lawfully in suspending Parliament
- A decision from the court is due “early next week”
- The judges have heard two appeals: one by campaigner Gina Miller’s team and one by the government, contesting a Scottish court ruling that the decision was unlawful
- The government has intimated that prorogation is not a matter for the courts
- Ex-PM Sir John Major argued Parliament was suspended to stop MPs interfering with Brexit and was met with howls of derision and hypocrisy for doing so
- A written government submission to the court suggests it could seek another prorogation if it loses the case
- Meanwhile, the government says it’s given the EU documents reflecting its Brexit “ideas” – but no “formal written solutions” yet
Lady Hale, president of the Supreme Court, summed up the tension of three days of potentially historic debate: “None of this is easy.”
She says: “I must repeat this case is not about when and what terms the UK leaves the EU. We are solely concerned with the lawfulness [of prorogation].”
They then asked for time to deliver the verdict, we are in unprecedented constitutional territory here with many not sure what options are available to the judges. Questions continue to be raised around who exactly is funding Gina Miller to undertake this case against the British Government.
